A Crime Victim may initially have interacted with the police, been interviewed, and may have made a written statement for the police. The Victim may have been examined at a hospital or hospitalized for injuries. A Crime Victim can feel a mix of strong emotions - anger, fear, PTSD. The Victim may strongly want to see the perpetrator who hurt her/him receive the largest punishment possible. The Victim may feel intimidated by 'the legal system'. In some cases the Victim may interact with a Victim's Advocate who works with the Office of the County Attorney. The victim may worry and feel 'I'm to blame for this happening'. It's said 'Hindsight is 20-20', & the Victim may feel 'I should have x', 'I never should have done y', ''I should have reacted by doing a b c'. If another person's also been hurt, the Victim may feel 'Survivor Guilt', feeling 'I should have protected x, but instead I did y'. Legal question: My court case says it's 27JV22-xxxx. What does all this mean? Attorney Tricia Dwyer's answer: Hello-excellent question! Most likely this is a confidential court record - 'JV' is an abbreviation for juvenile. You wrote it's your records, so I urge you not to post on any public websites about this, but please do choose one attorney with whom you feel great safety and trust and have private, one to one, legal advice. Legal question: Can I be made to testify against my own brother? I'm scared I'll wind up beaten to a pulp or worse. Attorney Tricia Dwyer's answer: If you are a witness to the crime or otherwise have important knowledge, the state (prosecution) may subpoena you. I've had multiple clients who are living in very real fear. If you're in fear for your physical safety or that of other loved ones, I urge you to have help aimed at keeping you and your loved ones safe. Legal question: I called a hotel as a prank but turns out my friends were on conference call and said stuff about gun. Police called me. Can I get in trouble? Attorney Tricia Dwyer's answer: Hello. First, I urge you not post details about this on public websites. Based on what you wrote, I urge you to carefully choose one lawyer at this time and have private and confidential legal advice now. Beware all 'free advice', and beware signing any paperwork. Legal question: I was sitting in car in park & police came & said they'd been told I seemed suspicious. I was unnerved. Legal of them?? Attorney Tricia Dwyer's answer: Hello. You wrote how you were 'alone', which suggests to me the circumstances may have been suspicious. Also, be aware that police may be notified of suspicious behavior in many ways - for example, someone on the street calls out to the officers in a squad car. It's really important that we're all respectful to all law enforcement, plus all first responders - the work officers do for us - people in the community - is extremely important, essential. Remember no one's 'out to get you' - officers are concerned about things such as pedophile lurking, concern for your welfare. ALWAYS have hands up and open. NEVER make any fast movements of any sort. ALWAYS be totally respectful, NEVER rude or 'difficult' or 'noncompliant'. Identify who you are if asked. If you have a problem about what unfolded, in my work, a person will be in the Attorney-Client relationship with me and we'll discuss what happened - most often there will be real time video to view. Think of 'what if I was in their shoes'! Also, you yourself please think about a career in law enforcement - you clearly are a careful and detailed and conscientious person!! Excellent questions. |
